These Terms of Service (the "Terms") govern your access to and use of cubixhosts.com, the Cubix Hosting website, the Cubix Hosting platform or control panel, our game-server hosting services, support channels, community spaces, and related products and functionality (together, the "Services").
The Services are operated by Cubix Hosting ([CUBIX HOSTING LEGAL ENTITY — TO BE INSERTED BEFORE LAUNCH]) ("Cubix Hosting," "Cubix," "we," "us," or "our"). By creating an account, placing an order, using the Services, accessing a server, joining an official support channel, or otherwise using Cubix Hosting, you agree to these Terms.
If you do not agree to these Terms, do not use the Services. If you use the Services on behalf of a company, organization, community, server network, or other entity, you represent that you have authority to bind that entity to these Terms, and "you" includes both you and that entity.
These Terms are intended to be read together with our Privacy Policy, Acceptable Use Policy, billing terms, plan descriptions, support policies, and any other terms or rules we publish for specific Services. If there is a conflict between these Terms and a service-specific written policy, the service-specific policy controls for that specific issue.
IIntroduction and Scope
Cubix Hosting provides game-server hosting and related tools that allow customers to order hosting plans, deploy and manage servers, configure server software, upload or generate files, access support, and use related platform features.
These Terms apply to:
- Your Cubix Hosting account and account credentials.
- Orders, subscriptions, renewals, cancellations, refunds, credits, invoices, and billing activity.
- Hosted servers, game nodes, backups, files, worlds, plugins, mods, server jars, modpacks, configurations, logs, databases, and other content associated with your Services.
- The Cubix Hosting website, store, platform, control panel, documentation, support channels, Discord community, and other official Cubix Hosting spaces.
- Your conduct, your users' conduct, and activity occurring through servers, accounts, credentials, or Services you control.
You are responsible for your account, your servers, the content and software you run, the people you authorize to access your Services, and compliance with these Terms. Cubix Hosting is not responsible for third-party software, plugins, mods, server jars, modpacks, bots, APIs, payment tools, websites, Discord servers, communities, or other services that you choose to use with your server.

IIEligibility and Accounts
To create an account, place an order, or use the Services, you must be able to enter into a legally binding agreement with Cubix Hosting. You may not use the Services if you are prohibited from doing so under applicable law, subject to sanctions or restricted-party rules, previously suspended or terminated by Cubix Hosting, or otherwise barred from receiving the Services.
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian. By allowing a minor to use the Services, the parent or legal guardian agrees to these Terms on the minor's behalf and is responsible for the minor's use of the Services, account activity, payments, servers, Customer Content, and compliance with these Terms.
You agree to provide accurate, current, and complete account, contact, and billing information and to keep that information updated. We may use your account email address, billing information, support history, payment information, fraud signals, and other account details to verify your account, process orders, contact you about the Services, investigate abuse, or comply with law.
You are responsible for maintaining the confidentiality and security of your login credentials, email account, authentication methods, API keys, access tokens, control-panel sessions, and any sub-user or team access you create or authorize. You should use a strong and unique password and enable any additional security features we make available. If you need another person to help manage a server, use any team, sub-user, role, permission, or access-control features we provide instead of sharing your personal login credentials.
You are responsible for all activity that occurs under your account, through your servers, through your credentials, or through people you authorize to access your Services. We may treat actions taken through your account, control panel, server console, API credentials, support channels, or authorized users as actions taken by you.
You must notify us promptly at support@cubixhosts.com if you believe your account, email address, credentials, server, or Services have been compromised or used without authorization. We may require verification of account ownership before restoring access, disclosing information, changing account details, or taking other account-related actions. If you lose access to the email address associated with your account, we may be unable to recover the account or associated server content unless you can verify ownership to our satisfaction.
We may refuse registration, reject orders, limit the number of accounts you may create or control, require additional verification, restrict access, suspend Services, or terminate accounts where we believe it is necessary to protect Cubix Hosting, prevent fraud or abuse, comply with law, enforce these Terms, resolve billing or identity concerns, or protect other customers, players, providers, or the public.
We may identify accounts, services, payment methods, devices, IP addresses, Discord accounts, support tickets, or other signals that appear to be under common ownership, control, influence, or operation ("Associated Accounts"). If one account or service is involved in fraud, abuse, evasion, non-payment, chargebacks, policy violations, or harmful activity, we may take action against any Associated Accounts, including limiting, suspending, terminating, refusing service, or denying re-registration where appropriate.
You may not create or use additional accounts to evade payment obligations, fraud checks, resource limits, support restrictions, suspensions, bans, disputes, chargebacks, abuse investigations, enforcement actions, or other limitations imposed by Cubix Hosting.
IIIServices, Plans, and Server Resources
Cubix Hosting offers game-server hosting plans, add-ons, platform tools, and related services described on our website, order pages, plan pages, control panel, documentation, or written service descriptions. The specific features, limits, pricing, billing cycle, included resources, support scope, and available add-ons for a Service are determined by the plan or order you select at the time of purchase, as modified by any later plan changes, upgrades, downgrades, promotions, or written agreements.
Plan descriptions may reference resources such as memory, CPU allocation, storage, databases, backups, network connectivity, locations, game versions, slots, modpack support, plugin support, DDoS protection, or other features. Unless we expressly state otherwise in writing, resource allocations are provided for normal game-server use and are subject to fair-use, abuse-prevention, network-integrity, security, and platform-stability requirements.
[PLAN RESOURCE MODEL — CONFIRM BEFORE LAUNCH, INCLUDING WHETHER RAM/CPU/STORAGE ARE HARD LIMITS, FAIR-USE LIMITS, OR PLAN-DEPENDENT]
We may monitor resource usage, node health, network usage, container metrics, Redis memory usage, storage usage, process activity, and other operational metrics to operate the Services, enforce plan limits, troubleshoot issues, prevent abuse, and maintain performance for customers. We may limit, throttle, suspend, migrate, restart, isolate, or terminate a Service if we believe it is causing instability, degrading other customers' services, violating these Terms, exceeding applicable limits, or creating security, legal, operational, or network risk.
You are responsible for choosing a plan that fits your server's software, player count, plugins, mods, modpacks, worlds, storage, database use, and performance needs. Server performance may vary based on many factors outside Cubix Hosting's control, including game version, plugins, mods, server jars, modpacks, world size, entities, redstone, farms, databases, scripts, player behavior, configuration, software optimization, and third-party services.
We may provide tools, installers, templates, modpack installers, plugin installers, configuration helpers, migration tools, backups, databases, or other convenience features. These tools are provided to help you use the Services, but you remain responsible for reviewing configurations, verifying compatibility, maintaining backups, complying with third-party licenses and game rules, and confirming that your server functions as intended.
We may modify, replace, add, suspend, discontinue, migrate, or remove features, plans, locations, nodes, add-ons, software versions, templates, panels, integrations, or other parts of the Services from time to time. Where a change materially reduces an active paid Service, we will provide notice where reasonably practicable or where required by law, but urgent security, abuse, infrastructure, provider, or legal issues may require changes without advance notice.
Any beta, preview, experimental, early-access, trial, promotional, complimentary, temporary, or test features are provided as-is, may be changed or discontinued at any time, may be subject to additional limits, and may not be covered by the same support, uptime, refund, backup, or continuity expectations as paid production Services unless we expressly state otherwise in writing.
We may move your Service between nodes, machines, locations, IP addresses, data centers, providers, or infrastructure environments when reasonably necessary for maintenance, upgrades, performance, security, abuse response, capacity management, provider issues, disaster recovery, or operational reasons. We will try to minimize disruption where practicable, but migrations may affect IP addresses, availability, performance, latency, or configuration.

IVCustomer Content, Server Files, and Player Data
As between you and Cubix Hosting, you retain the rights you have in the files, worlds, plugins, mods, modpacks, configuration files, databases, logs, uploads, and other content you upload to, create through, store on, or run using the Services ("Customer Content"). Cubix Hosting does not claim ownership of your Customer Content.
You grant Cubix Hosting a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, cache, back up, restore, migrate, process, monitor, scan, troubleshoot, modify for technical operation, and otherwise use Customer Content as reasonably necessary to provide, secure, support, maintain, improve, enforce, and operate the Services; comply with law; respond to abuse; resolve disputes; and perform actions you request.
You are solely responsible for Customer Content and for activity on or through your servers, including content or data created, uploaded, transmitted, stored, generated, or accessed by your staff, players, users, plugins, mods, bots, scripts, APIs, databases, integrations, or other third-party software.
You represent and agree that you have all rights, licenses, consents, and permissions necessary to upload, store, run, distribute, display, transmit, process, or otherwise use Customer Content through the Services. You may not use the Services to host or distribute content that infringes intellectual property rights, violates privacy rights, violates publicity rights, violates law, violates game publisher rules, or violates these Terms or our Acceptable Use Policy.
If you run a Minecraft server or other game server, you are responsible for complying with the applicable game's EULA, commercial-use guidelines, server rules, brand guidelines, marketplace rules, mod/plugin licenses, and any other rules imposed by the game developer, publisher, mod author, plugin author, platform, marketplace, or community whose software or content you use. Cubix Hosting does not grant you rights to Minecraft, Mojang, Microsoft, or any third-party game, mod, plugin, brand, artwork, software, or content.
Your server may collect or process information from players or users, including usernames, UUIDs, IP addresses, chat messages, commands, gameplay events, permissions, plugin data, mod data, payment or store data, Discord data, or other personal information. You are responsible for providing any privacy notices, obtaining any required consents, moderating your community, responding to player requests, and complying with laws that apply to your collection or use of player or user information.
Cubix Hosting may access, review, preserve, disclose, remove, suspend, restrict, or disable Customer Content, servers, files, backups, logs, or account access where we believe it is necessary or appropriate to provide support, troubleshoot issues, investigate abuse, enforce these Terms, prevent harm, protect infrastructure, comply with law, respond to legal process, address intellectual-property complaints, resolve billing disputes, or protect Cubix Hosting, customers, players, providers, or the public.
We are not required to monitor Customer Content, player activity, server chat, plugins, mods, or third-party integrations, and we do not assume responsibility for moderating your server or community. However, we may investigate or take action if we become aware of activity that may violate these Terms, our policies, law, provider requirements, or the rights or safety of others.
You are responsible for keeping independent copies of important Customer Content. Any backup or recovery features we provide are subject to Section VIII and are not a substitute for your own external backups.

VAcceptable Use and Prohibited Activity
You must use the Services lawfully, responsibly, and in a way that does not harm Cubix Hosting, our infrastructure, our providers, our customers, players, or the public. This Section applies to all Services, accounts, servers, Customer Content, users, players, sub-users, Associated Accounts, and activity originating from or connected to your Services.
You may not use, allow, encourage, or facilitate use of the Services for any of the following:
- Illegal activity: violating applicable law, regulation, court order, legal process, or third-party rights.
- Unauthorized access: hacking, credential theft, brute forcing, exploitation, privilege escalation, bypassing authentication, probing systems without authorization, or attempting to access systems, networks, accounts, data, or services you do not own or have permission to access.
- Network attacks: launching, controlling, participating in, facilitating, threatening, or testing denial-of-service attacks, distributed denial-of-service attacks, amplification attacks, traffic floods, stressers, booters, or similar abusive traffic.
- Misuse of DDoS protection: intentionally attracting attacks, stress-testing mitigation without written permission, attempting to bypass mitigation, or using the Services to absorb or redirect abusive traffic for unrelated systems.
- Malware and harmful software: hosting, distributing, executing, or facilitating malware, ransomware, botnets, droppers, remote shells, keyloggers, stealers, credential harvesters, phishing kits, malicious scripts, or similar tools.
- Phishing, scams, and impersonation: operating fake login pages, fake support pages, impersonation services, fraudulent stores, account generators, credential-selling services, or other deceptive or fraudulent activity.
- Spam and abusive messaging: sending unsolicited bulk messages, spam, phishing messages, abusive notifications, or unauthorized commercial messages, or operating open relays, open proxies, or similar abuse-enabling services.
- Port scanning and reconnaissance: running port scans, vulnerability scans, mass scanning, scraping, reconnaissance, or probing against external systems without authorization.
- Intellectual-property infringement: hosting, distributing, or linking to pirated, cracked, stolen, leaked, or unlicensed software, games, media, server jars, plugins, mods, modpacks, license keys, accounts, credentials, or other protected materials without authorization.
- Harmful or unlawful content: hosting, distributing, or facilitating content involving child sexual abuse material, exploitation, terrorism, violent extremism, credible threats, doxxing, non-consensual intimate content, unlawful harassment, or other content that may require immediate removal or reporting.
- Resource abuse: excessive or abusive use of CPU, memory, disk I/O, storage, databases, network, processes, file counts, backups, or other resources in a way that degrades infrastructure, harms other customers, evades limits, or exceeds normal game-server use.
- Cryptocurrency and compute-heavy workloads: cryptocurrency mining, mining pools, mining proxies, token farming, AI/ML training, compute farming, password cracking, or similar compute-heavy workloads unless Cubix Hosting expressly authorizes them in writing for a plan that supports them.
- Storage or distribution abuse: using game-server hosting primarily as file storage, object storage, backup storage, CDN, media hosting, software distribution, warez hosting, torrenting, or large-scale download hosting unrelated to the hosted game server.
- IP, routing, and network abuse: IP spoofing, MAC spoofing, ARP spoofing, unauthorized routing announcements, route hijacking, packet crafting for abuse, or other network manipulation.
- Circumvention and evasion: bypassing plan limits, rate limits, security controls, fraud checks, suspensions, bans, payment restrictions, support restrictions, or other enforcement actions.
- Interference with Cubix systems: reverse engineering, scraping, disrupting, overloading, attacking, modifying, or interfering with the Cubix Hosting website, platform, panel, APIs, billing systems, support systems, monitoring systems, infrastructure, or security controls except as permitted by law or a written authorization from Cubix Hosting.
- Misleading or harmful server operations: misleading players, donors, customers, or the public about your relationship with Cubix Hosting; misrepresenting performance, sponsorship, official status, pricing, refunds, ownership, moderation, or server rules; or operating a server in a way that creates legal, security, or reputational risk for Cubix Hosting.
Attempting, preparing, assisting, encouraging, or enabling any prohibited activity is also prohibited, even if the activity is not completed.
We may investigate suspected violations and may take action including warnings, support restrictions, rate limits, process termination, firewall rules, traffic filtering, file removal, server isolation, suspension, termination, refusal of service, denial of refunds, preservation of evidence, reporting to providers or authorities, or action against Associated Accounts. Serious violations may result in immediate suspension or termination without advance notice.
We may consider context, severity, intent, risk, legal obligations, provider requirements, repeat behavior, impact on others, and whether you cooperate with our investigation when deciding what action to take. We are not required to provide advance warning before acting where immediate action is needed to protect Cubix Hosting, customers, players, infrastructure, providers, or the public.
[VULNERABILITY DISCLOSURE / AUTHORIZED SECURITY TESTING RULES — TO BE CONFIRMED BEFORE LAUNCH]
VIBilling, Payments, Renewals, and Taxes
By placing an order, starting a subscription, renewing a Service, upgrading a plan, purchasing an add-on, adding account credit, or otherwise purchasing from Cubix Hosting, you agree to pay all applicable fees, charges, taxes, and other amounts shown at checkout, in the billing panel, on the invoice, in the order flow, or in the applicable written service description.
Unless we expressly state otherwise, hosting Services are provided on a prepaid basis. This means payment is due before the Service is activated or renewed. Recurring Services renew automatically at the end of each billing cycle unless you cancel before renewal according to the cancellation process we provide.
The standard billing cycle for hosting Services is monthly unless a different billing cycle is shown at checkout or expressly agreed by Cubix Hosting in writing.
Plan upgrades and downgrades: When you upgrade a Service to a higher plan tier or add resources mid-cycle, the upgrade takes effect immediately and the prorated price difference for the remaining billing period is charged to your payment method at that time. When you downgrade a Service to a lower plan tier or reduce resources, the downgrade takes effect at the start of your next billing cycle; no partial refund or credit is issued for the current period. Downgrades are not available mid-cycle on quarterly or annual commitments — you may request a downgrade to take effect at your next renewal date. In some cases, an upgrade or resize may require migrating your server to a different node; we will minimize disruption where practicable and your server data will be preserved.
Payments are processed through Stripe using the payment methods Cubix Hosting makes available at checkout, which may include payment cards and bank-account payment methods supported by Stripe. Cubix Hosting does not store full payment card numbers. By submitting a payment method, you authorize Cubix Hosting and our payment processors to charge that payment method for initial purchases, recurring charges, renewals, upgrades, add-ons, taxes, fees, and other amounts you authorize or that become due under these Terms.
You are responsible for keeping your billing information, payment method, billing address, tax information, account email address, and invoice contact information accurate and up to date. We are not responsible for failed payments, service interruptions, suspension, termination, data loss, bank fees, overdraft fees, currency-conversion fees, payment-processor fees, or other costs resulting from inaccurate billing information, expired payment methods, declined payments, or your failure to review invoices or account notices.
Invoices, receipts, renewal reminders, payment-failure notices, or billing notices may be sent through the platform, email, billing panel, support system, or other official communication channels. Failure to receive or read a notice does not waive your payment obligations.
If a payment fails, is reversed, is disputed, is charged back, is flagged as fraudulent, or is not received by the due date, we may suspend, restrict, terminate, or refuse the affected Services and any Associated Accounts. We may also require additional verification, require payment through a different method, refuse future orders, recover unpaid amounts, or pass through fees or costs where permitted by law and our payment-provider rules.
If an invoice or recurring payment is not paid by the due date, the affected Service enters a three (3) calendar day grace period. During the grace period, we may continue attempting payment collection and may send overdue notices as a courtesy. If payment is still not received after the grace period, we may suspend or restrict the affected Service. If payment remains unpaid fourteen (14) calendar days after the due date, we may terminate the affected Service and delete associated server files, backups, logs, databases, configurations, and related Customer Content. Reactivation or recovery after termination is not guaranteed.
[CHARGEBACK / PAYMENT DISPUTE FEE POLICY — TO BE CONFIRMED BEFORE LAUNCH]
Prices, plan features, discounts, promotions, taxes, and fees may change over time. If we materially increase the recurring base price of an active paid Service, we will provide notice where reasonably practicable or where required by law. Unless otherwise stated, price changes apply at the next renewal or purchase after the change takes effect. If you do not agree to a price change, your remedy is to cancel the affected Service before renewal.
Promotions, discounts, coupons, trials, credits, or special offers may be subject to additional terms, may apply only once, may be limited to new customers or specific Services, may expire, may not be transferable, and may be modified or discontinued at any time unless we state otherwise in writing.
Account credits, promotional credits, goodwill credits, downgrade credits, or other non-cash credits have no cash value, are not bank deposits, are not stored funds held for your benefit, are not transferable, and are not withdrawable unless required by law or expressly stated by Cubix Hosting in writing. Credits may be applied only to eligible Cubix Hosting Services.
Listed prices may not include sales tax, VAT, GST, use tax, withholding tax, or other government-imposed taxes, duties, levies, or fees unless expressly stated. Where required, taxes may be calculated and added at checkout or invoicing based on your billing information, location, tax status, or other legally relevant details. You are responsible for any taxes that apply to your purchase or use of the Services, excluding taxes based on Cubix Hosting's net income.
[TAX / VAT / GST COLLECTION APPROACH — TO BE CONFIRMED BEFORE LAUNCH]
VIICancellations, Suspensions, Terminations, and Refunds
You may cancel a recurring Service through the billing panel, control panel, support process, or other cancellation method we make available. Cancellation stops future renewals for the affected Service, but it does not automatically refund amounts already paid unless you are eligible for a refund under this Section or applicable law.
7.1 Seven-Day Refund Window
Eligible first-time hosting orders may be refunded if you request a refund within seven (7) days after the Service is created or activated in our systems. The refund window is measured from service creation or activation, not necessarily from the time your payment is authorized, captured, or processed.
Refund requests must be submitted through an official Cubix Hosting support channel, such as support@cubixhosts.com, and you must be able to verify account ownership. Refunds are issued to the original payment method where reasonably possible. If a refund to the original payment method is not available, we may issue account credit or another remedy where appropriate and permitted by law.
7.2 Refund Limits and Exclusions
Unless required by law or expressly approved by Cubix Hosting in writing, refunds are not available for:
- Renewal payments after the initial seven-day refund window.
- Add-ons, upgrades, extra resources, one-time services, setup services, migration services, priority support, custom work, or other non-recurring purchases once provisioned, used, or started.
- Account credit, promotional credit, goodwill credit, downgrade credit, gift credit, or other non-cash credit.
- Services terminated, suspended, restricted, or refused because of fraud, abuse, non-payment, chargebacks, payment disputes, policy violations, illegal activity, or violations of these Terms.
- Services affected by third-party plugins, mods, modpacks, server jars, scripts, configurations, worlds, databases, or software that Cubix Hosting does not control.
- Performance issues caused by customer configuration, unsupported software, excessive plugins or mods, oversized worlds, resource abuse, player activity, third-party integrations, or failure to follow reasonable support guidance.
- Domain names, external third-party products, or provider pass-through costs if we offer them and they are not refundable by the relevant provider.
Refunds outside the seven-day window may be granted at Cubix Hosting's discretion or where required by law. We may choose to issue account credit instead of a cash refund where appropriate, including for goodwill adjustments, billing corrections, downgrade balances, partial service issues, or situations where the original payment method cannot be refunded.
7.3 Renewals and Cancellation Timing
Recurring Services renew automatically unless canceled before renewal. You are responsible for canceling Services you no longer want before the renewal date. Failure to use a Service, forgetting to cancel, not receiving a reminder, losing access to your account email, or no longer needing a server does not automatically entitle you to a refund.
Cancellation must be submitted before the renewal payment is processed to avoid renewal charges. Renewal payments are not guaranteed to be refundable unless required by law or expressly approved by Cubix Hosting in writing. If a cancellation is submitted after a renewal payment is processed, the cancellation generally applies to the next billing cycle.
7.4 Suspensions and Terminations
We may suspend, restrict, terminate, or refuse any Service, account, order, or Associated Account if we believe it is necessary to protect Cubix Hosting, enforce these Terms, prevent abuse, comply with law, address provider requirements, resolve billing concerns, investigate fraud, protect customers or players, or preserve network and platform stability.
Reasons for suspension or termination may include:
- Non-payment, failed payments, chargebacks, payment disputes, fraud flags, or billing verification issues.
- Violations of these Terms, the Acceptable Use Policy, service-specific rules, provider requirements, or applicable law.
- Resource abuse, security risk, DDoS activity, malware, spam, phishing, cryptocurrency mining, unauthorized access, or other prohibited activity.
- Actions that harm or risk harm to Cubix Hosting, our providers, other customers, players, infrastructure, systems, reputation, or the public.
- Attempts to evade enforcement through Associated Accounts, alternate payment methods, VPNs, false information, or other circumvention.
Suspension may limit access to your server, panel, files, backups, support features, billing features, or account until the issue is resolved. Termination may permanently end access to the affected Service and may result in deletion of server files, backups, logs, databases, configurations, and related Customer Content according to our retention and backup practices.
For non-payment, the affected Service may be suspended after the three (3) calendar day grace period and may be terminated with associated data deleted fourteen (14) calendar days after the due date, as described in Section VI. Serious abuse, fraud, chargebacks, illegal activity, security risks, or provider requirements may result in faster suspension or termination.
7.5 Chargebacks and Payment Disputes
If you have a billing concern, contact support@cubixhosts.com before initiating a chargeback or payment dispute. Chargebacks and payment disputes create fraud, compliance, and payment-processing risk. If you initiate a chargeback, payment dispute, reversal, or similar payment challenge, we may suspend or terminate the affected Services and any Associated Accounts, restrict future purchases, require additional verification, and contest the dispute with relevant account, billing, usage, support, and service records.
Opening a chargeback or payment dispute may make the affected payment ineligible for voluntary refund consideration while the dispute is pending. This does not limit any rights you may have under applicable law or payment-network rules.

7.6 Our Cancellation Without Cause
If Cubix Hosting discontinues a paid Service or terminates an active paid Service without cause and not because of your breach, fraud, non-payment, abuse, chargeback, legal issue, provider requirement, or risk to the Services, we may provide a prorated refund or account credit for the unused prepaid portion of the affected Service, unless a different remedy is required by law or stated in a service-specific policy.
VIIIBackups, Data Loss, and Service Recovery
You are responsible for maintaining your own independent backups of any files, worlds, configurations, databases, plugins, mods, logs, and other Customer Content that are important to you. Cubix Hosting may provide backup, restore, snapshot, archive, or recovery features, but those features are provided as a convenience and are not a guarantee against data loss.
Backups may fail, be delayed, become corrupted, be incomplete, be overwritten, be unavailable, or be deleted as part of normal retention, suspension, termination, migration, abuse response, storage management, provider failure, software failure, or operational processes. We do not guarantee that any particular backup will exist, be current, be restorable, or contain all Customer Content.
You are responsible for testing your server, plugins, mods, worlds, databases, backups, and configuration after changes, migrations, restores, updates, or support actions. If you ask us to perform a restore, migration, troubleshooting action, plugin/mod change, reinstall, reset, repair, or other support action, you understand that data may be changed, overwritten, lost, or become incompatible.
Cubix Hosting is not liable for data loss, corruption, deletion, rollback, incompatibility, failed backups, failed restores, server resets, software corruption, plugin/mod conflicts, customer error, unauthorized account access, third-party software issues, provider outages, suspension, termination, or other loss of Customer Content except where liability cannot be excluded under applicable law.
Customer-facing backup features are provided for customer use and may vary by plan, server type, storage usage, control-panel settings, and operational limits. Backup frequency, limits, and retention may be shown in the control panel, plan details, documentation, or applicable service description. If no specific backup period is shown, you should treat backups as temporary convenience copies and maintain your own external backups of important data.

IXSupport and Customer Responsibilities
Cubix Hosting may provide support through FreeScout, support@cubixhosts.com, Discord, the control panel, documentation, or other official channels. Support availability, response times, scope, and escalation paths may vary based on plan, issue type, workload, staffing, time zone, abuse status, billing status, and any support add-ons or service-specific policies.
Support is intended to help with Cubix Hosting Services. Unless we expressly agree otherwise, support may not include custom plugin development, mod development, custom code debugging, world building, server administration for your community, moderation, third-party store setup, Discord bot development, custom permissions configuration, custom gameplay balancing, or support for third-party services outside our control.
You agree to provide accurate, complete, and relevant information when requesting support, including the affected server, issue description, error messages, logs, screenshots, recent changes, plugin/mod list, reproduction steps, and any other details reasonably needed to investigate. We may be unable to help if information is missing, inaccurate, misleading, or withheld.
You remain responsible for decisions you make based on support guidance. If we provide instructions, suggestions, scripts, commands, configuration changes, restore options, reinstall options, or troubleshooting steps, you are responsible for reviewing them, understanding the risks, and backing up important data before proceeding.
We may refuse, limit, or deprioritize support for abusive behavior, harassment, threats, spam, excessive duplicate tickets, false reports, chargebacks, unpaid invoices, unsupported software, prohibited activity, or issues outside the support scope. Discord and public community spaces may be used for general help, but sensitive account, billing, security, privacy, or server-data issues should be handled through official private support channels.
Standard support hours are Monday through Friday, 9:00 AM to 5:00 PM Eastern Time, excluding holidays. We may respond outside standard support hours at our discretion, but response outside those hours is not guaranteed unless a specific plan, add-on, or written agreement states otherwise.

The Services may rely on or interact with third-party providers, platforms, software, games, APIs, payment processors, infrastructure providers, security providers, analytics tools, support tools, mods, plugins, modpacks, server jars, databases, bots, websites, Discord communities, and other third-party products or services.
Third-party services and software are governed by their own terms, licenses, privacy policies, rules, fees, limitations, and availability. You are responsible for reviewing and complying with those third-party terms. Cubix Hosting is not responsible for third-party services or software that we do not own or control, including their performance, availability, security, compatibility, data practices, pricing, support, updates, takedowns, or changes.
If you install or use plugins, mods, modpacks, server jars, databases, scripts, bots, APIs, websites, stores, payment tools, Discord integrations, or other third-party software with your server, you are responsible for ensuring they are lawful, licensed, secure, compatible, updated, and appropriate for your use. Third-party software may create security risks, performance issues, crashes, data loss, privacy obligations, or legal obligations.
Cubix Hosting may provide links, installers, templates, one-click tools, recommendations, documentation, or support references for third-party software. Those features do not mean Cubix Hosting owns, endorses, guarantees, audits, or assumes responsibility for that third-party software unless we expressly state otherwise in writing.
Provider, platform, game, marketplace, developer, publisher, payment, or infrastructure requirements may require us to suspend, modify, restrict, remove, migrate, or terminate Services or Customer Content. We are not liable for third-party provider actions, policy changes, outages, takedowns, software changes, security issues, or incompatibilities except where liability cannot be excluded under applicable law.
XIIntellectual Property
Cubix Hosting and its licensors retain all rights, title, and interest in and to the Cubix Hosting website, platform, control panel, software, interfaces, designs, graphics, logos, trademarks, service marks, trade names, documentation, content, systems, tools, code, workflows, and other materials we provide or develop, excluding Customer Content.
Subject to your compliance with these Terms, Cubix Hosting grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for their intended purpose during the period in which you maintain an active account or paid Service. This license does not grant you ownership of any Cubix Hosting intellectual property.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, extract source code from, interfere with, bypass, scrape, or create derivative works from Cubix Hosting software, systems, interfaces, or materials except as expressly permitted by law or by written permission from Cubix Hosting.
You may not use Cubix Hosting's name, logos, branding, domain names, trade dress, screenshots, marketing materials, or confusingly similar marks in a way that suggests sponsorship, endorsement, partnership, employment, official status, or control unless we expressly authorize it in writing.
If you provide feedback, ideas, suggestions, reports, feature requests, improvements, or other comments about the Services, you grant Cubix Hosting the right to use them without restriction or compensation to you. This does not give us ownership of your Customer Content.

To the maximum extent permitted by applicable law, Cubix Hosting disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted service, error-free operation, compatibility, security, availability, data retention, or that defects will be corrected.
Cubix Hosting does not guarantee that the Services will be uninterrupted, error-free, secure, attack-proof, DDoS-proof, always available, compatible with all software, free from data loss, free from latency, or suitable for every game, modpack, plugin, world, configuration, player count, business model, or community. Hosting performance depends on factors that may include your plan, node load, network conditions, game version, mods, plugins, world size, entities, scripts, databases, player activity, third-party integrations, attacks, provider issues, software bugs, and configuration choices.
Any uptime, performance, latency, DDoS protection, backup, support, migration, or compatibility statements are subject to the limitations and exceptions in these Terms and any applicable service-specific policy. Marketing descriptions, comparison pages, estimates, benchmarks, examples, screenshots, or documentation are for general informational purposes and are not guarantees unless expressly stated as binding terms in writing.
Some jurisdictions do not allow certain disclaimers, so some of the disclaimers above may not apply to you. In those cases, the disclaimers apply to the maximum extent permitted by law.

- Your violation of these Terms, the Acceptable Use Policy, service-specific terms, third-party terms, game EULAs, mod/plugin licenses, or applicable law.
- Your infringement or alleged infringement of intellectual property, privacy, publicity, or other rights.
- Your collection, use, disclosure, or processing of player, user, customer, staff, or community data.
- Fraud, abuse, chargebacks, payment disputes, security incidents, or harmful activity connected to your account or Services.
We may control the defense and settlement of any matter subject to indemnification, and you agree to cooperate with us. You may not settle any claim in a way that imposes obligations on Cubix Hosting, admits fault by Cubix Hosting, or affects Cubix Hosting's rights without our prior written consent.
XVDisputes, Governing Law, and Venue
If a dispute, claim, billing concern, service concern, abuse enforcement concern, or other issue arises between you and Cubix Hosting, you agree to first contact us through an official support channel and give us a reasonable opportunity to investigate and resolve the issue informally before filing a legal claim, unless doing so would be prohibited by law or urgent legal relief is required.
For informal resolution, contact support@cubixhosts.com and include your account email address, affected service, relevant invoice or transaction ID, a clear description of the issue, and the remedy you are requesting. We may ask for additional information to verify account ownership, investigate the issue, or evaluate the request.
These Terms and any dispute arising out of or relating to these Terms, the Services, your account, your servers, billing, support, Customer Content, or your use of Cubix Hosting are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Subject to any consumer-protection rights, jurisdictional requirements, or venue rules that cannot be waived, you and Cubix Hosting agree that any lawsuit or court proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in or serving Broward County, Florida, including the United States District Court for the Southern District of Florida where federal jurisdiction exists.
You and Cubix Hosting consent to the personal jurisdiction and venue of those courts and waive objections based on inconvenient forum or improper venue, except where such waiver is not permitted by law.
Nothing in this Section prevents Cubix Hosting from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, systems, infrastructure, customers, providers, network integrity, or the security and operation of the Services.
